Rent agreement in Dehradun 2026: stamp duty, e-stamp and registration
In Uttarakhand a lease of up to one year pays 2% stamp duty on the total rent. A lease of more than a year must be registered. Here is how it works in Dehradun in 2026.

What changed in 2026
Most of the rules for a rent agreement in Dehradun are old. The stamp duty rates come from the Indian Stamp Act, 1899 as amended for Uttarakhand, and the duty to register long leases comes from the Registration Act, 1908. Several things around them have moved in the last year.
Tenant checks got tougher. Dehradun police fined 41 landlords and owners ₹4.10 lakh in an October 2026 drive, and 12 PG and hostel operators ₹1.20 lakh, for not verifying tenants. We covered this in our post on tenant verification fines in Dehradun. Police verification is a separate duty from the agreement. Doing one does not do the other.
The tenancy law is in question next door. In August 2026 the Allahabad High Court struck down rent revision and eviction sections of Uttar Pradesh's 2021 tenancy law. Uttarakhand's own Tenancy Act, 2021 has very similar sections. Our post on the Uttarakhand Tenancy Act and the UP ruling explains what that means here.
Registration went online on paper, but we could not confirm it for leases. The state cabinet approved the Uttarakhand Online Document Registration Rules, 2025 in May 2025, ETV Bharat reported, for registry by video conferencing with Aadhaar checks. Uttarakhand Awaaz reported that on 11 November 2025 Chief Secretary Anand Bardhan directed that virtual registration start statewide from 1 April 2026. We found no report confirming that it is now running, or that it covers lease deeds. Ask the sub-registrar before you rely on it.
The registration fee cap doubled. A state notification dated 7 November 2025, signed on 16 November, changed the maximum in the table of registration fees from ₹25,000 to ₹50,000. The department's older fee schedule still shows ₹25,000 against leases. For an ordinary home rent this cap rarely matters, because 2% of the rent is far below it.
How to make a rent agreement in Dehradun, step by step
The rates below are from the Stamp and Registration Department's published schedule of stamp duty and registration fees, read on 21 October 2026. The schedule is undated, and as noted above it still shows the old ₹25,000 fee cap, so confirm the current figures at the sub-registrar's office.
- Decide the term. This decides both the stamp duty and whether you must register. Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases of immovable property "from year to year, or for any term exceeding one year, or reserving a yearly rent". That is why so many home agreements are written for 11 months. An 11-month agreement does not have to be registered. It still has to be stamped.
- Work out the stamp duty. Under Article 35 of the schedule, as the department lists it:
- Lease up to 1 year: 2% of the whole amount of rent.
- Over 1 year, up to 5 years: 2% of three times the average annual rent.
- Over 5 years, up to 10 years: 2% of four times the average annual rent.
- Over 10 years, up to 20 years: 2% of five times the average annual rent.
- Over 20 years, up to 30 years: 2% of six times the average annual rent.
- Over 30 years, perpetual, or no fixed term: 5% of the market value of the property.
The schedule also has a proviso for a lease of a flat in a building for up to five years. There the duty is 2% of the whole rent for the full term plus any premium or money advanced, with a minimum of ₹100 and a maximum of ₹10,000, rounded up to the next ₹10. The schedule's text is partly cut off at this point. It does not say plainly whether an independent house or a shop counts, or whether a refundable security deposit counts as "money advanced". Ask the sub-registrar or stamp office before you pay.
- Buy the stamp as an e-stamp. Stock Holding Corporation of India (SHCIL) runs e-stamping in Uttarakhand for the state. Its website lists Uttarakhand among the states where a citizen can pay online and print the e-stamp certificate. You can also buy one at an authorised collection centre. Put the names of both parties and the stamp duty amount on it correctly, and check the certificate number on SHCIL's site.
- Write the agreement. Print it on or attach it to the e-stamp certificate. Both sides sign every page, with two witnesses. Section 12 of the Uttarakhand Tenancy Act, 2021 says the agreement is signed in duplicate and each side keeps an original. Our owner checklist for renting out a house or shop lists the clauses to include.
- Register it if the term is over a year. Take it to the sub-registrar's office with both parties, the two witnesses and ID. Section 23 of the Registration Act says a document must be presented within four months of the date it is signed. The department's schedule sets the registration fee on a lease at:
- Up to 1 year: 2% of the total rent for the whole term.
- Over 1 year, up to 20 years: 2% of the average annual rent.
- Over 20 years, up to 90 years, or no fixed term: 2% of three times the average annual rent.
Each of these has a maximum, which the schedule shows as ₹25,000 and the November 2025 notification raised to ₹50,000.
- Tell the Rent Authority, if one is working. Section 4 of the Uttarakhand Tenancy Act, 2021 says no one may let or take premises except by a written agreement, which landlord and tenant must jointly report to the Rent Authority within two months. Section 4(6) says that without this neither side can claim relief under the Act. The Act comes into force on a date the state notifies. The Urban Development Department's page for the Act, updated on 29 December 2025, lists only the Act itself. We found no commencement notice and no Rent Authority working in Dehradun. Ask the District Magistrate's office.
- Get the tenant verified by police. Do this before handing over the keys and keep the record with the agreement. See our post on tenant verification in Dehradun.
- Keep the deposit within the Act's limits. Section 11 of the Tenancy Act caps the security deposit at two months' rent for a home and six months' rent for a shop or office. It must be refunded when the tenant hands back vacant possession, after deducting what the tenant owes.
What it means for tenants and landlords
This section is our view, with worked examples. They are not legal advice. Have a lawyer check anything unusual, such as a commercial lease, a lease with a premium, or a term over five years.
An 11-month agreement on a ₹15,000 flat. Total rent is ₹1,65,000. At 2%, stamp duty is ₹3,300. If the stamp office counts a ₹30,000 deposit as money advanced, the base becomes ₹1,95,000 and the duty ₹3,900. No registration is needed.
A three-year agreement on the same flat. Average annual rent is ₹1,80,000. The general rule gives 2% of three times that, or ₹10,800. If the flat proviso applies, the duty is capped at ₹10,000. Registration is compulsory, and the fee at 2% of the average annual rent comes to ₹3,600.
Do not under-stamp to save money. A few hundred rupees saved on the stamp can make the agreement hard to use as evidence in a dispute. Some rent-agreement websites quote Uttarakhand rates that do not match the department's schedule. Go by the schedule and the sub-registrar, not a website.
Notarising is not registering. Many 11-month agreements in Dehradun are notarised. That records the signatures. It is not registration under the Registration Act, and it does not replace the stamp.
Landlords: keep the paper trail together. Keep the stamped agreement, the police verification slip, the deposit receipt and rent receipts in one file. A clean file helps if a tenant will not leave or a deposit is disputed.
Tenants: ask for your original. The Tenancy Act says each side keeps an original. If the landlord holds both, ask for yours. If you are still looking, browse flats and houses for rent in Dehradun. The department's schedule sets 2% of the total rent for a lease of up to one year. For a flat let for up to five years it gives a minimum of ₹100 and a maximum of ₹10,000. Confirm whether the deposit is added with the stamp office.
Can I buy an e-stamp for a rent agreement in Dehradun online?
