Dehradun flat buyers 2026: pick RERA or consumer forum, not both

Uttarakhand's state consumer commission has dismissed a Sahastradhara Road flat buyer's case because the family had already taken the same dispute to RERA. Here is what it means.

Dehradun flat buyers 2026: pick RERA or consumer forum, not both

What happened

The ruling. Amar Ujala reported on 30 August 2026 that the Uttarakhand State Consumer Disputes Redressal Commission dismissed a complaint by a family who had bought a flat in a Sahastradhara Road project. The order was given by a bench of the commission's president, Kumkum Rani, and member BS Manral. The commission held that the family had already chosen the Uttarakhand Real Estate Regulatory Authority (RERA) as their forum for the same dispute, so they could not bring it again before the consumer commission.

The history of the case. According to the report, the family booked a 1,535 sq ft flat, number 403, in 2015 and paid about ₹48.23 lakh. Possession was due by February 2019 but was not given. The family complained to RERA in 2019. On 18 December 2019, RERA ordered the builder to hand over the flat and pay interest for the delay. A recovery certificate for ₹78.19 lakh was issued on 20 January 2022.

A settlement that did not hold. On 25 September 2022, the two sides signed what the report called a full and final settlement. The family was to get a bigger flat, number 702, of 2,275 sq ft, in place of the old one. The ₹78.19 lakh in the recovery certificate was to be adjusted, and the family was to pay ₹15 lakh more in three instalments. Before the consumer commission, the family asked for possession of flat 702 and ₹10 lakh in compensation for mental agony and financial loss.

Why the commission said no. The builder said the family had not paid the agreed ₹15 lakh. The commission found no document showing the family had offered that money. It also noted that execution proceedings at RERA in the same matter were still pending. Citing Supreme Court rulings, it applied the principle of "estoppel by election": when a person has two parallel remedies for one dispute and picks one, they cannot use the other at the same time for the same cause. The report did not name the builder company or say what the family plans to do next.

The Supreme Court position. Consumer forums and RERA can both hear homebuyer cases. In Imperia Structures v Anil Patni, decided on 2 November 2020, the Supreme Court held that Section 79 of the RERA Act bars only civil courts, not consumer forums, and that the two remedies coexist, according to a case summary on Lawfoyer. A 1 June 2026 Bar & Bench article by two lawyers says the court has since narrowed this. It describes a 4 February 2026 Supreme Court ruling, Kabra and Associates v Rekha Rajkumar Hemdev, from Maharashtra. There, buyers who went to MahaRERA and withdrew over a wrong project name, with liberty to refile, were held to have made their choice and could not take the same claim to a consumer forum.

RERA's caseload. On 14 October 2026, the Uttarakhand RERA website showed 705 registered projects, 1,372 complaints registered and 1,150 disposed of.

What it means for buyers and sellers in Dehradun

This section is our view.

Choose your forum once, and carefully. If a builder delays your flat, you can usually go to RERA or to a consumer commission. After this ruling, assume you cannot do both for the same dispute. Talk to a lawyer about which suits your claim before you file.

A RERA order is only as good as its execution. This family won at RERA in 2019 and got a recovery certificate in 2022. Nearly seven years later, they still did not have a flat. If you win, follow up the execution steps yourself, and keep a record of every hearing.

Read any settlement before you sign it. A settlement can replace the RERA order you won. Make sure it says clearly what happens if either side misses a payment or a date. Pay by bank transfer to the project account and keep proof. If you offered to pay and the builder refused, write it down and send it by email or registered post. The commission found no such proof in this case.

Check before you book. Look up the project and the promoter on the Uttarakhand RERA website before you pay a token. Our post on RERA's 2026 rules for Dehradun flat buyers explains the bank account and map-stage checks. Our list of checks before you pay for a flat covers the paperwork.

Ready homes carry less of this risk. Most of these disputes are about delayed possession. You can compare ready flats and houses for sale in Dehradun on ILA Infra.

Questions people ask

Can I complain to both RERA and the consumer forum about the same flat?

Going by this August 2026 order and the Supreme Court rulings it relied on, no. Once you choose one forum for a dispute, you are expected to stay with it.

What did RERA order in the Sahastradhara Road case?

According to Amar Ujala, RERA ordered the builder on 18 December 2019 to give possession and pay interest for the delay. A recovery certificate for ₹78.19 lakh followed on 20 January 2022.

Does withdrawing a RERA complaint let me go to the consumer forum instead?

Not safely. A Bar & Bench article on the Supreme Court's February 2026 Kabra ruling says buyers who withdrew from MahaRERA on a technical point could not then go to a consumer forum.
