Uttarakhand UCC wills 2026: what changes for Dehradun family property

What happened

The amendment became law in April. The Uttarakhand government brought in the Uniform Civil Code (Amendment) Ordinance, 2026 on 27 January 2026, according to All India Radio News. The UCC portal's list of government orders shows it was followed by the Uniform Civil Code, Uttarakhand (Amendment) Act, 2026, dated 7 April 2026. So the changes are now part of the Act, not a temporary ordinance.

What changed on succession. ETV Bharat listed the changes when the ordinance came into force. Two touch inheritance directly. First, the Registrar-General now has the power to cancel registrations of marriage, divorce, live-in relationships and succession. Muslim Mirror reported the same power, saying it applies "if irregularities are found". Second, the word "widow" was replaced with "spouse" in the succession provisions. ETV Bharat also reported that a case will move automatically to the registrar and Registrar-General if a sub-registrar does not act within the set time, and that penalties can be recovered like land revenue.

None of the reports we read said exactly how a cancellation of a succession registration will work, what notice the family gets, or how to challenge it. All India Radio described the changes as procedural, administrative and penal.

How many wills are being registered. ETV Bharat reported on 15 January 2026 that 4,816 people had applied to register a will under the UCC. Of these, 3,849 were approved, 857 rejected and 109 pending. That is about one in six rejected. The same report gave Dehradun district's total across all UCC services as 61,446 applications, with 58,160 approved. It did not split Dehradun's figure by service. We could not find newer portal figures for wills published after January.

How a will is registered. Amar Ujala reported when the UCC came in that a person can register a will through a short video of themselves and two witnesses, after logging in with Aadhaar. A handwritten or typed will can also be uploaded, or the portal form filled in. Only a person aged 18 or above and of sound mind can do this. A rejected application can be appealed online within 30 days. Amar Ujala also reported that the sub-registrar only records that a person has named certain heirs. It does not decide whether the will is valid. In March 2025, Amar Ujala reported that will registration was opened at sub-registrar offices in all 13 districts, alongside Common Service Centres.

The inheritance rules underneath. LiveLaw's analysis of the Act says the first class of heirs is the spouse, children, children and spouses of predeceased children, and parents. It says the Act drops the old Hindu law split between ancestral and self-acquired property, and gives daughters the same share as sons across communities. Members of Scheduled Tribes are exempt from the Act and follow customary law.

What it means for buyers and families in Dehradun

This section is our view.

Registering a will under the UCC is not the same as transferring land. The portal records a will. The property still has to be mutated in the revenue or municipal records after a death, and that is a separate process at the tehsil or Nagar Nigam. Ask the tehsil office which papers it accepts before you assume the UCC certificate is enough.

Buying inherited property? Get every heir to sign. Under the UCC, a daughter, a spouse and the parents of the person who died can all be first-class heirs. A sale signed only by the sons is a common source of later disputes. Ask for the death certificate, the will or succession record, and the consent or signatures of every heir. Our list of papers to check before buying a plot in Dehradun covers the rest.

A registration can now be cancelled. Because the Registrar-General can cancel an irregular succession registration, a buyer should not treat that record as final proof of title. Check the land records as well, and use a lawyer if the family history is messy. Read our post on 2026 Dehradun land fraud cases for how forged papers are used.

Writing a will? Keep it simple and clear. One in six will applications was rejected, according to the January figures. The reports did not give reasons. Describe each property with its khasra number or house address, name each heir clearly, and keep the witnesses' Aadhaar details ready.

Scheduled Tribe families are different. If a family belongs to a Scheduled Tribe, the UCC does not apply and customary law governs inheritance. Take local legal advice before buying land from such a family.

Questions people ask

Is will registration compulsory under the Uttarakhand UCC?

The reports we read describe registration as available through the UCC portal, sub-registrar offices and Common Service Centres. None said an unregistered will becomes invalid. Check with a lawyer for your case.

Do daughters get an equal share of property in Uttarakhand?

According to LiveLaw's analysis of the Act, daughters and sons get equal shares, and there is no longer a split between ancestral and self-acquired property. This does not apply to Scheduled Tribe members.

Can a UCC succession registration be cancelled?

Yes. Under the 2026 amendment, the Registrar-General can cancel registrations of succession, as well as marriage, divorce and live-in relationships, where irregularities are found.
