Nainital homestay crackdown, October 2026: what hill-home buyers should know
Nainital officials sealed two homestays and fined 22 units at Kainchi Dham on 8 October 2026. With new 2026 homestay rules, a hill home bought for rental income needs care.

What happened
Kainchi Dham inspections. Amar Ujala reported on 8 October 2026 that a tourism department team made surprise checks on hotels and homestays in the Kainchi Dham area of Nainital district. Action was taken against 26 units. Twenty-two were fined ₹10,000 each, two homestays were sealed on the spot and four operators got show-cause notices. The paper said the team found missing rate lists, more rooms being run than were registered, and units running with no registration at all. District Tourism Development Officer Kirti Chandra Arya told the paper that harassment of tourists and pilgrims would not be tolerated and that surprise checks would continue.
An earlier, bigger sweep. This follows a district-wide drive in May. ETV Bharat reported on 31 May 2026 that, on District Magistrate Lalit Mohan Rayal's orders, joint teams of SDMs and the tourism department cancelled the registration of 150 homestays and fined 55 units ₹10,000 each. The Nainital area accounted for 94 of the cancellations, Ramnagar 20, Dhari 19, Kainchi Dham 7, Haldwani 5 and Kaladhungi 5. The reasons given included owners not living in the property, no parking, hotel-style reception staff, and homestays being leased out for commercial use.
Building rules tightened too. At the Nainital District Development Authority board meeting on 4 July 2026, chaired by Kumaon Commissioner Deepak Rawat, the board decided that no new construction would be allowed in landslide-prone areas without scientific testing, Amar Ujala reported. It said maps of up to 60 square metres would be approved for local residential needs in the Bhimtal area. Separate applications from several family members in different names, for what was really a commercial building, would be rejected. Old buildings could only be rebuilt to their earlier approved size. The commissioner also directed joint inspections to seal all illegal homestays.
The state rules behind this. On 15 January 2026, the state cabinet approved new registration rules for tourism businesses, homestays and bed and breakfast units, ETV Bharat reported. Only permanent residents of Uttarakhand can register a homestay. ETV Bharat's earlier reports said the owner must live in and run the homestay, that units run through a caretaker would be treated as bed and breakfast instead, and that outsiders can run a bed and breakfast but must register for GST and pay full taxes. Registrations are to be renewed every five years.
Where sources differ. The room limit is reported differently. ETV Bharat, before the cabinet meeting, gave a maximum of six rooms. Amar Ujala reported on 13 May 2026 that the limit had gone up from five to eight rooms. Figures for registered homestays also differ: a tourism official quoted by ETV Bharat in January put it at about 6,000 across the state, while the May Amar Ujala report said over 1,000. Both agree Nainital district has the most. We have not seen the final notified rules.
What it means for buyers in Dehradun comparing hill towns
This section is our view.
Do not count on homestay income unless you are a permanent resident. Many Dehradun families look at a cottage in Bhimtal, Mukteshwar or near Kainchi Dham and plan to cover the cost by letting rooms. Under the 2026 rules, only permanent residents can register a homestay, and the owner has to live there. If you live in Dehradun and plan to leave a caretaker in charge, expect to be treated as a bed and breakfast, with GST and commercial costs.
Check the registration before buying a running homestay. If a seller pitches a property as an "earning homestay", ask for the tourism registration certificate, the number of rooms it covers and the name it is in. A registration does not pass to you with the sale. Ask whether the unit has had any notice, fine or cancellation in 2026.
Check the map, and the slope. In Nainital district, an extra floor or extra rooms built beyond the approved map are now a real risk. Ask for the approved map from the development authority and match it to what is built. On a hill plot, ask whether the site falls in a landslide-prone area, because new construction there now needs scientific testing first. Outside buyers also face the state's land purchase limits, which we explain in our post on buying land in Uttarakhand from outside.
Dehradun may be the simpler bet for some. A home in Dehradun is easier to rent to long-term tenants and does not depend on tourist seasons. Compare options on our property in Uttarakhand page and our stays in Dehradun listings before you decide.
Questions people ask
Can someone from Dehradun run a homestay in Nainital?
A permanent resident of Uttarakhand can register a homestay if they live in and run it themselves, according to ETV Bharat's reports on the 2026 rules. A unit run through a caretaker is treated as a bed and breakfast.
Why were homestays sealed at Kainchi Dham?
Amar Ujala reported missing rate lists, more rooms than registered and units with no registration. Two homestays were sealed and 22 units were fined ₹10,000 each on 8 October 2026.
Can I build a holiday home anywhere in the Nainital hills?
Not freely. The Nainital District Development Authority decided in July 2026 that new construction in landslide-prone areas needs scientific testing first, and that building beyond an approved map can lead to demolition.
