A Nagar Nigam shop sold three times: the Ghosi Gali case, and why a leased shop is not yours to sell

What happened

One shop, three buyers. Doon Horizon reported on 15 September 2026 that a commercial shop in Ghosi Gali, leased by the Dehradun Nagar Nigam on a premium of ₹33 lakh, had been sold against the rules to three different buyers. The paper said the case came to light after a departmental inquiry, and the municipal commissioner recommended action on 5 September 2026.

A final notice, then nothing. The Nagar Nigam's land section sent the lessee, named in the report as Mohammad Yunus of Ghosi Gali, a letter giving him three days to deposit ₹28,84,315 in dues. Eleven days later, the paper said, nothing had been paid.

Seizure and a new auction. On the commissioner's orders, the Nagar Nigam is preparing to take back physical possession of the shop and auction it publicly again. Officials told the paper the Uttar Pradesh Municipal Corporation Act, 1959, as it applies in Uttarakhand, and the terms of the lease deed had been breached. The dues are to be recovered like land revenue arrears, through a recovery certificate, with the district administration's help.

Why it matters to buyers

This section is our view.

A lease is not ownership. Many shops in Dehradun's old markets, and some plots, are on lease from the Nagar Nigam, the Cantonment Board or the government (nazul land). The lessee can use the property on the lease's terms but usually cannot sell it without the lessor's permission. A "sale" by a lessee may leave the buyer with nothing when the lessor takes the property back, as here.

Ask who the real owner is. Before you buy a shop, ask for the title document. If it is a lease deed, read who the lessor is, how long the lease runs, whether transfer is allowed, and on what terms. Then ask the lessor, in writing, whether the dues are paid and whether a transfer would be approved.

Check for dues before you pay. Unpaid lease rent, premium or house tax can follow the property. Ask the Nagar Nigam's land and tax sections for a no-dues statement on the shop.

Three buyers means three payments. If the same property can be sold to three people, a registry search would have shown the earlier transfers. Our post on the Haridwar Road flat sold twice explains the encumbrance search that catches this.
